Challenging the Use of Digital Evidence ISB#22-1768


Description
In this interactive discussion, participants will review the Supreme Court’s 2014 decision in Riley v. California, which unanimously recognized the significant privacy interests inherent in digital devices. The presentation will also provide a background overview of managing and reviewing digital evidence discovery. Participants will become familiar with suppression challenges to digital searches conducted pursuant to a warrant. And participants will briefly explore other challenges in the non-warrant context—such as consent and the border search authority—as well as under the Fifth Amendment with compelled decryption of digital devices.
